1. Agreement and incorporated terms
These Driver Platform Terms govern each person or business that applies to provide or provides Delivery Services through CommuterCart. They supplement the Terms of Service at /terms. The Privacy Policy, Driver Privacy Notice, Screening Notice, Biometric Information Notice, transaction offer card, and policies expressly linked from those documents are incorporated by reference. If these Driver Terms directly conflict with the general Terms on a Driver-specific issue, these Driver Terms control.
A Driver must be at least 18, legally authorized to contract, and approved for the account, vehicle, service area, and delivery category used. An individual may not share an account or permit another person to perform an accepted delivery unless CommuterCart has approved that person and arrangement in writing.
2. Independent business
CommuterCart’s required operating model is a network of independent transportation businesses, not employees. Except where applicable law classifies the relationship differently, each Driver is an independent service provider operating a business separate from CommuterCart. The Driver decides when and where to be available, which opportunities to accept, the lawful route and method of performance, and whether to use competing platforms or serve the Driver’s own customers. Declining an opportunity does not trigger retaliation or loss of ordinary Platform access. CommuterCart does not guarantee opportunities, hours, territory, exclusivity, earnings, or profit.
Drivers supply and control their vehicle, phone, equipment, fuel, maintenance, insurance, licenses, permits, parking, tolls, and other business expenses. A Driver has no authority to bind CommuterCart, negotiate for it, represent an employment relationship, or make warranties on its behalf. Any Class D opportunity is optional, separate from delivery compensation and ordinary Platform access, and does not require a schedule or minimum hours. Classification depends on actual practice and applicable law, not this label; any nonwaivable rights remain unaffected.
3. Eligibility, verification, and screening
A Driver must provide accurate and current identity, contact, license, vehicle, registration, insurance, payout, tax, and qualification information. CommuterCart may verify this information initially and periodically and may require a lawful consumer report or identity check. The Screening Notice at /screening-notice and separate authorization govern covered reports; the Biometric Information Notice at /biometric-notice and separate consent govern regulated biometric processing.
A Driver must promptly report an expired, suspended, revoked, cancelled, or materially restricted license, registration, insurance policy, permit, credential, or legal authority; a collision or safety event relevant to Platform work; or another change materially affecting eligibility. Verification is not an endorsement or guarantee to any user.
4. Opportunities, acceptance, and performance
Offer cards may display item information, required qualifications, route, estimated distance, timing, expected payout, service mode, and other material conditions. Rankings, route fit, timing, and earnings estimates may be generated by TransportAI and are not guarantees. The Driver remains free to accept or decline an available opportunity.
Acceptance creates a commitment by the Driver’s business to perform the confirmed Delivery Services safely, promptly, and through the approved account holder or other personnel separately verified and authorized for that account, in accordance with the offer card, lawful instructions, these Driver Terms, and applicable law. A Driver may cancel only for a legitimate reason and must promptly use the Platform cancellation or safety process. CommuterCart may reassign a delivery when needed for safety, service, fraud prevention, or completion.
5. Vehicle, insurance, and safety
A Driver must maintain a safe, roadworthy, properly registered and inspected vehicle suitable for every accepted item and must maintain all insurance and financial responsibility required for delivery activity. Personal auto insurance may exclude delivery for hire. CommuterCart's review of proof of insurance does not determine whether a particular claim is covered.
A Driver must remain sober, alert, licensed, and medically fit; obey traffic, parking, distracted-driving, loading, securement, weight, and vehicle laws; use lawful hands-free practices; never overload or obstruct the vehicle; and refuse an item that cannot be safely loaded, secured, transported, or delivered. Emergencies must be directed to emergency services first.
6. Item custody and delivery records
The Driver must verify the item and visible condition at pickup, maintain chain of custody, protect it from loss, theft, contamination, weather, unauthorized access, and avoidable damage, and follow lawful handling and contactless-delivery instructions. A Driver may refuse prohibited, unsafe, misdescribed, unpackaged, oversized, or incompatible items and must not open or use an item except when lawfully necessary for safety or compliance.
The Driver must create truthful pickup, route, attempted-delivery, return, and completion records. Photographs and signatures must be limited to the item and authorized area unless additional documentation is reasonably necessary. A Driver may not place an item in or retrieve anything from a USPS mailbox or interfere with U.S. Mail.
7. Privacy, confidentiality, and communications
Delivery information may be used only to perform the accepted delivery, address safety or support, and satisfy legal duties. A Driver must protect names, addresses, access codes, telephone numbers, item details, merchant information, photographs, and location data; may not retain, publish, sell, profile, solicit, harass, or contact a participant for an unrelated purpose; and must securely delete locally stored information when no longer needed.
The Driver Privacy Notice at /driver-privacy explains CommuterCart's processing of Driver and applicant information. During availability and active deliveries, the Platform may collect and share location, route progress, events, and proof records as described there and in the Privacy Policy. Disabling required permissions may prevent offers, tracking, mileage calculation, or payment.
8. Payouts, expenses, and taxes
The confirmed offer card or payout statement controls compensation for a delivery, subject to disclosed tips, adjustments, cancellations, returns, chargebacks, fraud review, legal withholding, and corrections. A Driver must review reported activity promptly and dispute an apparent error through /support with available records. CommuterCart may delay a payout while reasonably investigating fraud, safety, ownership, completion, legal process, or payment failure.
Unless law provides otherwise, the Driver is responsible for business expenses and all federal, state, and local tax obligations. The Driver authorizes CommuterCart and its providers to collect taxpayer and payout information, issue required information returns, apply backup withholding, and report payments as required by law.
9. Conduct and account integrity
A Driver may not discriminate, harass, threaten, retaliate, carry a weapon unlawfully, use another person's account, falsify identity or records, manipulate GPS or timing, stage or steal a delivery, solicit an off-platform transaction to avoid fees, coordinate fraudulent claims, misuse promotions, or interfere with another user. Ratings and feedback must be truthful, delivery-related, and nonretaliatory.
Account access is personal. Helpers, substitute personnel, or subcontractors are prohibited unless CommuterCart approves the arrangement in writing, verifies each person as required, and the arrangement is lawful. Approval does not relieve the Driver of responsibility for performance, insurance, confidentiality, taxes, safety, or compliance.
10. Restriction, deactivation, and appeal
CommuterCart may temporarily restrict or deactivate an account for an immediate safety risk, suspected fraud, invalid credentials, legal process, nonpayment, material breach, or repeated failure to complete accepted services. Voluntary inactivity or declining unaccepted opportunities alone is not a basis for adverse treatment; a long-dormant account may require fresh security or eligibility verification before reactivation. When law permits and doing so would not compromise safety, fraud prevention, an investigation, or legal process, CommuterCart provides notice of the action and principal reason.
A Driver may appeal through /privacy-request by selecting Automated Decision Review or Appeal and providing the account contact information, decision challenged, and supporting records. A person authorized to review and correct relevant information will evaluate the appeal. CommuterCart ordinarily acknowledges an appeal within 10 business days and aims to issue a decision within 30 days, subject to legally required periods and reasonable extensions for complex investigations. Review does not guarantee reinstatement. Any state-specific deactivation right or shorter deadline controls.
11. Incidents, claims, and cooperation
A Driver must promptly report collisions, injuries, item loss or damage, theft, suspected prohibited contents, Recipient disputes, law-enforcement contact, and material safety events, preserve relevant evidence, and cooperate reasonably with legitimate claims, insurance, payment, and legal reviews. Cooperation does not require waiver of a nonwaivable right or admission of fault.
12. Disputes and general provisions
The arbitration agreement, jury-trial and class-action waivers, opt-out right, governing law, disclaimers, liability limitations, indemnification, intellectual-property rules, and general provisions in the Terms of Service at /terms apply to these Driver Terms to the maximum extent permitted by law. Nothing waives a Driver right that cannot lawfully be waived.
These Driver Terms, incorporated documents, and each accepted offer are the entire agreement on their subjects unless a signed Driver agreement expressly controls. If one provision is unenforceable, the remainder continues. Obligations concerning payment, taxes, confidentiality, privacy, claims, intellectual property, disputes, and accrued liability survive termination.

Driver questions, safety reports, delivery claims, legal notices, and arbitration opt-outs may be submitted through /support using the corresponding request type.
